A Buena Vista man was indicted by a Rockbridge County grand jury last week for several felonies in connection with a domestic incident in the Dover Lane area last May.
Dustin Kane Floyd, 34, was directly indicted on six felony charges in connection with the incident: abduction, strangulation, domestic assault (third or subsequent offense), possession of a firearm by a violent felon, maliciously discharging a firearm in an occupied dwelling, and using a firearm in commission of a felony.
The incident occurred on May 13, 2025, and was reported to the Rockbridge County Sheriff’s Office the following day by a forensic nurse at Augusta Health who examined the victim.
According to the call logs from the sheriff’s office of the nurse’s call, the victim said that Floyd had struck her in the head with a pistol and had also “discharged it once in her direction.” The nurse also reported that the victim said she’d been strangled and that Floyd had broken her phone and slammed a door on her foot.
The victim was treated for head contusions, a sprained foot and “scratches on her throat.” The nurse further reported that Floyd had at one point handed the gun to the victim after holding it to his own head and “asked her to shoot him and call it self-defense.”
The victim took the gun and discarded it “at the mill hole off McClung Road.” The area was searched and the firearm was located on May 15. Floyd was arrested the following day, initially charged with many of the same felonies he was indicted on, except for the felony domestic assault charge. He was initially charged with misdemeanor domestic assault, along with a felony count of property damage and a misdemeanor count of prohibiting the victim from calling 9-1-1.
Floyd was initially indicted on these same charges last July, along with the property damage charge. The commonwealth’s attorney’s office filed a motion to nolle prosequi the charges late last year, citing the unavailability of a witness during the originally scheduled January trial as well as the fact that forensic analysis of the firearm would not be ready until February. The motion was granted, giving the commonwealth’s attorney leave to refile the charges at a later date. All of the charges except the property damage charge have now been refiled and will move forward.
Floyd was taken into custody on May 8 and is currently being held without bond at Rockbridge Regional Jail.
-A Lexington man was also indicted by the grand jury for one count of possession of more than 100 grams of methamphetamine with intent to distribute and other felonies stemming from an arrest last October.
Jason Christopher Mays, 48, was arrested on Oct. 1, 2025, following a police chase on Blue Hill Lane which ended with Mays losing control of his vehicle and crashing. A search of the vehicle found four bags of a white powder that totaled more than 100 grams and was believed to be methamphetamine, as well as several small jars of a “green leafy substance” located in and around the vehicle and three bags of plant material. The powder was tested by the forensic lab in Roanoke and was found to contain methamphetamine hydrochloride and was determined to be 97.7 percent pure. The leafy substance and the plant material were also tested and determined to be marijuana.
In addition to the drug charge, Mays was also charged with one felony count of eluding police and driving with a suspended or revoked license when he was taken into custody.
He was indicted on those three charges, along with another felony count of possession of a schedule I or II drug with intent to distribute (third or subsequent offense), in February. The three original charges were dismissed via nolle prosequi motion in March, while a motion to quash the third offense possession with intent to distribute charge is currently pending before the Rockbridge County Circuit Court.
Filed by James Doss, Mays’ defense attorney, the motion argues that the two drug possession charges violate Mays’ protection against being “twice put in jeopardy for the same offense” guaranteed in Article 1, Section 8 of the Virginia State Constitution. It violates that right, Doss argues, due to the evidence for both charges being the same and the only difference between the charges is that they are defined by separate subsections of the same statute, and each “impose separate minimum mandatory, consecutive sentences upon conviction.”
A charge of possession of 100 grams of methamphetamine or more carries a mandatory minimum sentence of 20 years and a charge of a third offense possession with intent to distribute carries a mandatory minimum sentence of 10 years, which must be served consecutively with any other sentences.
Rockbridge County Commonwealth’s Attorney Jared Moon has not filed his response to the motion as of Tuesday morning, but told The News-Gazette he plans to oppose the motion. The hearing is scheduled for June 2.
Mays is currently being held without bond in the Rockbridge Regional Jail. -Among the other indictments were charges against a pair of North Carolina men related to a break-in at Duke’s Antique Store on Christmas Eve.
Joseph Lee Walker, 37, of Graham, N.C., and Phillip Anderson Williams, 55, of Whitesett, N.C., were each indicted on one count of the following felonies: entering a building at night with intent to commit larceny, conspiracy to enter a building at night to commit larceny, possession of burglary tools, destruction of property, and possession of ammunition by a convicted felon. Additionally, Walker was indicted on one count of possession with intent to distribute 10 grams or more of methamphetamine, and Williams was indicted on one count of possession of methamphetamine. Williams is also charged with one misdemeanor count of possession of drug paraphernalia.
Williams is scheduled to be arraigned on May 18. No date had been set for Walker’s arraignment as of Tuesday morning. -The following individuals were also indicted by the Rockbridge County grand jury on May 4: Richard T.
