Question Raised About Supervisor’s Legal Standing

A question has been raised regarding the legal validity of Jay Lewis serving as the Walkers Creek member of the Rockbridge County Board of Supervisors. A special meeting has been called for this Monday, March 30, at 5:30 p.m., to discuss the matter.

In a press release issued by the county administrator’s office this week, the Board of Supervisors announced “that a procedural question has been raised regarding the qualification of the elected supervisor for the Walkers Creek magisterial district, and that the board is taking prompt action to ensure the district retains full representation and that all county business proceeds in accordance with Virginia law.” 

According to the press release, “A question arose following [this past] Monday evening's board meeting regarding whether the Walkers Creek supervisor had completed the formal oath-of-office filing process required by Virginia law for his new term, which began in January following his re-election last November.

“The board has referred the matter to the county attorney for legal review. The county is committed to ensuring that all legal requirements are satisfied and that the voters of the Walkers Creek District continue to be represented.”

The press release goes on to state that at the special meeting this Monday, “the board will consider a resolution directing the county attorney to petition the Rockbridge County Circuit Court to issue a writ of election for a special election to fill the Walkers Creek Magisterial District seat. The special election, if held, is expected to be scheduled in conjunction with the November 2026 general election. Additionally, the board, if it determines it is necessary, and in compliance with Va. Code § 24.2-226, will initiate the process of making an interim appointment to ensure the Walkers Creek district has a voting representative on the board while the special election process proceeds.

“Regarding the bond resolution related to the planned recreation center project that was on [this past] Monday's agenda: the county attorney is reviewing the legal status of that vote and will advise the board at [Monday’s special meeting]. The board is committed to ensuring that any action it takes on that matter is legally sound and in the best interests of Rockbridge County residents. All meeting notices and agendas will be posted on the Rockbridge County website at www.co.rockbridge.va.us.
